                      The minutes of the meeting held on Wednesday 4th December 2019 were agreed as a true record and signed by the Chairman.

68-19/20      To consider and possibly agree to respond to NALC on the Home Office consultation on strengthening police powers to tackle unauthorised encampments (details circulated prior to the meeting)

                      It was agreed unanimously to respond to NALC on the Home Office consultation on strengthening police powers to tackle unauthorised encampments.

69-19/20      If the above is agreed, to consider and possibly agree a response to NALC on the Home Office consultation on strengthening police powers to tackle unauthorised encampments (details circulated prior to the meeting)

 

                      It was agreed unanimously that Cllr Stewart would respond on behalf of MCC, supporting the strengthening of police powers to tackle unauthorised encampments.

70-19/20      To consider and possibly agree a response to The Essex County Council (Colchester Park and Ride Site, off A12 Junction 28) (Off-Street Parking Places) Order 2019

                      The following response was agreed:

                      MCC support the proposed introduction of the pay to park restrictions and note the reasons given.

                      MCC would ask Essex County Council to consider the safety of pedestrians using the Park and Ride car park for access to the football ground.

71-19/20      Planning, Licensing & Highways Applications/Appeals – To make recommendations, including requests for Section 106 money where applicable, on applications received

192959 – 229 Bergholt Road, Colchester   CO4 5AT – Replacement dwelling following demolition of bungalow and garage.

 

It was unanimously agreed to support this application.

 

193009 – 83 Apprentice Drive, Colchester   CO4 5SE – Electric roller garage door (and motor) fixed to applicant’s property to the front of carport – in accordance with and as advised by Crocodile. Sole purpose for the installation is to provide security for the family members (children) and to restrict access

 

It was unanimously agreed to object to this application due to the loss of light to the neighbouring property. It was also noted that the door was out of keeping with the street character.

 

192904 – Former Severalls Hospital Site, Boxted Road, Colchester   CO4 5HG – Application for variation of condition 2 following grant of planning permission 100502 – site-wide levels.

 

The Committee noted the application.

 

192993 – Colchester Hospital, Turner Road, Colchester – Erection of single deck car park with vehicular access from Turner Road, associated lighting and other ancillary works.

 

It was unanimously agreed to support this application.

 

190665 – Between Via Urbis Romanae & Mill Road, Land South of, Axial Way, Colchester – Hybrid planning application- Outline appln for healthcare campus   (5ha)of up to 300 older people’s homes (C3),4,300sqm private acute surgical hospital (C2),(1,200sqm.) medical centre (D1),3,600sqm, 75- bed care home (C2),up to 55742sqm offices (B1a)

 

It was agreed unanimously to object to this application as follows:

 

Myland Community Council withdraw their previous comments on this planning application in the light of recent changes to this application in respect of the proposed Village Green (Community Green). The reduction and change in acreage of the green from what was previously agreed, leaves this Council with no option but to object to this application on the grounds of material differences in agreed area sizes for the ‘community green’ as outlined and agreed at pre-planning meetings. Any reduction in size would also conflict with the Myland & Braiswick Neighbourhood Plan ENV1.

 

 

193059 – 72 Bergholt Road, Colchester   CO4 5AE – Resubmission of 191758. Demolition of existing single storey rear extension. Construction of a new two storey side and rear in-fill extension and rear single-storey lean-to extension.

 

It was agreed unanimously to support this application.

 

193945 – Land at, Oxley Parker Drive, Colchester –  Outline Application (all matters reserved) for the construction of up to 40 dwellings, public open space and associated infrastructure .

 

It was agreed unanimously to object to this application as follows:

 

“The Myland & Braiswick Neighbourhood Plan is quite clear on preserving designated open space and the CBC Local Plan, designates this as public open space and a previous application was rejected in 2003. The proposed application would double the current size of the estate and mean a minimum of 80 additional vehicles using the junction on Mill Road. Access to the site for building works would create a hazard due to the narrow road width in Oxley Parker and parked motor  vehicles. The proposed exit is onto Mill Road which is subject to traffic calming measures. The Southern section of the Northern Gateway Project have agreed not to use Mill Road due to our representations on traffic calming. To allow the use of Mill Road to building contractors would negate any benefits for the term of the build and future residents mean a substantial increase of traffic into and out of Oxley Parker Drive, the junction of which has a pedestrian crossing and bus stop in close proximity. Both school placement and medical infrastucture are stretched in this area already. This proposal is directly contrary to bpth Myland & Braiswick NP and the Local Plan and I would suggest there are no material considerations to warrant granting this application. Myland Council would, however, be prepared to discuss future use of this site as a public open space.”
