Minutes of the Myland Community Council Planning & Development Policy Committee Meeting held on Wednesday 16th   December 2015, 7.15 pm @ 101 Nayland Road, Mile End Road, Colchester, CO4 5EN

169-15/16     Apologies

Apologies were received from Cllrs Gray and Sutcliffe.

170-15/16     Declarations of Interest – Councillors to declare individually any interests they may have in the items on the agenda.  If a Councillor declares a Disclosable Pecuniary Interest in any item on the agenda he/she shall withdraw from the room where the meeting is being held when that item is discussed unless he/she has received a dispensation from the Clerk.

Cllr Dickinson declared a Disclosable Pecuniary Interest in application 152594 due to the application site being close to her residence. Cllr Dickinson left the room when this application was discussed and took no part in the discussion.

Cllr Hewitt said that he would be responding to a query from Cllr Dickinson on the Chesterwell development. Cllrs Hewitt, Dickson and Dickinson declared an interest in matters relating to this development due to their residences being close to the site. All Cllrs had requested dispensation, in writing to the Clerk, on the grounds that so many members of the decision-making body (P & DP) Committee) have a Disclosable Pecuniary Interest in the matter “that it would impede the transaction of the business.”

With regard to the Chesterwell development, as per provisions in the Localism Act and having had regard to all relevant circumstances, the Clerk and Chairman consider that dispensation be granted to all Cllrs on the grounds that so many members of the Committee have Disclosable Pecuniary Interests in the matter that it would “impede the transaction of the business” not to do so.

172-15/16     Chairman’s Announcements and Correspondence

The Chairman said he had spoken to Cllr Peter Pipik who was interested in joining the P & DP committee. He said Cllr Pipik would be attending the CBC Planning training in January and would come to the meeting of the P & DP committee on 20th January 2016.

176-15/16     Pre-planning matters for review

Cllr Hewitt said that Cllr Dickinson had raised a concern about the width of the turning head on Fords Lane. He said she was concerned that it looked too big and that the level looked high. He said it could be a temporary arrangement and that he would be meeting with the developers on 18th January 2016 and would raise the issue with them.

177-15/16     Planning, Licensing & Highways Applications/Appeals – To make recommendations, including requests for Section 106 money where applicable, on applications received (Appendix 1)

152536 – 108 Peto Avenue, Colchester CO4 5WL – Demolition of existing conservatory and new single storey extension to be built – Support

Cllr Dickinson left the room while application 152594 was discussed.

152594 – 4 Leechs Lane, Colchester CO4 5EP – Demolition of existing dwelling and erection of 3no. new dwellings with gardens and parking. Resubmission of 151594 – Object

MCC felt that this still represented over-development of the site, and that 2 dwellings would be more in keeping with the street scene and would remove some of the issues and concerns that residents have. MCC appreciate that the heights of the buildings have been reduced (to address overlooking of Howards Croft properties). MCC appreciate that the developer has made efforts to address concerns raised on the previous application.

Cllr Dickinson rejoined the meeting.
