Minutes of the Myland Community Council Planning & Development Policy Committee Meeting held on Wednesday 18th November 2015, 7.15 pm @ 101 Nayland Road, Mile End Road, Colchester, CO4 5EN

147-15/16     Apologies

Apologies were received from Cllr Gray.

148-15/16     Declarations of Interest – Councillors to declare individually any interests they may have in the items on the agenda.  If a Councillor declares a Disclosable Pecuniary Interest in any item on the agenda he/she shall withdraw from the room where the meeting is being held when that item is discussed unless he/she has received a dispensation from the Clerk.

Cllrs Dickinson, Dickson, Hewitt and Sutcliffe declared a pecuniary interest in applications 151099 and 151091 due to the application sites being close to their residences. All Cllrs had requested dispensation in writing to the Clerk, on the grounds that so many members of the decision-making body (P & DP Committee) have a Disclosable Pecuniary interest in the matter that it would “impede the transaction of the business”.

With regard to applications 151099 and 151091 – North Colchester Urban Extension, Mile End Road, Colchester, as per provisions in the Localism Act and having had regard to all relevant circumstances, the Clerk and Chairman consider that dispensation be granted to all Cllrs on the grounds that so many members of the Committee have Disclosable Pecuniary Interests in the matter that it would “impede the transaction of the business” not to do so.

152-15/16     Update of progress of resolutions made at the last meeting

The Chairman referred to Item 144-15/16 and application 150287, erection of a 1 x 4 bedroom house at land adjacent to Church Farm Way, Colchester, CO4 5JJ. He said this was an application to which MCC had objected. He said this application had been approved by CBC and that he had written to Mark Russell, the planning officer involved, to ask for the reasons why. He said he had received a response from Mr Russell which was available for members of the committee to look at if they wished.

The Chairman referred to Item 143-15/16 regarding asking ECC to implement a prohibition on HGVs using Mill Road, Colchester, between Severalls Lane and the Via Urbis Romanae. He said this had been taken to the MCC meeting held on 11th November 2015 where it had been approved. He said the letter had been written and sent to ECC.

155-15/16     Planning, Licensing & Highways Applications/Appeals – To make recommendations, including requests for Section 106 money where applicable, on applications received (Appendix 1)

152215 – 4 Carus Crescent, Colchester CO4 9FU – Proposed single storey rear and side extension with installation of roof lights and bi-fold doors to existing single storey rear projection. Realignment of existing brickwork boundary wall with replacement of timber fence to match existing. – Support

152290 – 210 Bergholt Road, Colchester CO4 5AS – Erection of new one bedroom bungalow to rear of site – Object

A resident who lived adjacent to the application site said he had concerns regarding the sewerage for the proposed dwelling. He said that the sewer pipe ran through his property and carried sewerage for his and one other property. He said that the pipe would not be up to current building standards and he had concerns about another property being added to the system. He said he was also concerned about the ground level as the site of the proposed dwelling was below that of his property and he felt the level would have to be raised before the proposed dwelling was built. He said there was no reference to this within the application. He said he was concerned that his property would be overlooked by the new dwelling. He said trees had already been cut down on the application site but that no mention had been made of this on the application. He said there were other trees very close to the site which should be inspected before any decision was made.

MCC would object on the grounds that there were concerns about:

  • The shared sewerage once another house was added to the system, which was old and probably not up to current standards.
  • Access to the proposed dwelling
  • Insufficient provision for a driveway and a turning area
  • Impairment of amenity for existing residents

It was also felt that the professional quality of the application was very poor, that there was no benefit to housing numbers in the building of a one bedroom dwelling and the application would lead to over-development.

Alterations to be made to existing bathroom to create enough space to a proposed staircase to provide access into the loft space area – Support

Comment – There were concerns about the potential for problems regarding noise in the future when houses were built close to this application site.

Comment – MCC would recommend that Sunday deliveries are limited to the hours between 10am and 4pm.
