Minutes of the Myland Community Council Planning & Development Policy Committee Meeting held on Wednesday 4 October 2017, 7.15 pm @ 101 Nayland Road, Mile End Road, Colchester, CO4 5EN

073-17/18     Apologies – to receive and accept

074-17/18    Declarations of Interest

Cllr Hewitt referred to the Chesterwell Design Brief that he would be discussing under Item 078-17/18.

Cllrs Dickson, Gray and Hewitt declared a pecuniary interest in application 172082 due to the application site being close to their residences. All Cllrs had requested dispensation in writing to the Clerk, on the grounds that so many members of the decision-making body (P & DP Committee) had a Disclosable Pecuniary Interest in the matter that it would “impede the transaction of the business”.

With regard to application 172082, as per provisions in the Localism Act and having had regard to all relevant circumstances, the Clerk and Chairman consider that dispensation be granted to all Cllrs on the grounds that so many members of the Committee have disclosable pecuniary interests in the matter that it would “impede the transaction of the business” not to do so.

076-17/18     Chairman’s Announcements and Correspondence

The Chairman said the budget for MCC for 2018/19 would be agreed in the next couple of months and the committee should decide whether they would need any money allocated for the forthcoming year.

The committee agreed that there was no need for them to make a request for any money to be allocated to the P & DP Committee for 2018/19.

Cllr Johnstone referred to planning application 162399 for land south of Cambian Fairview. He said the decision had been reached by CBC after nine deferrals. He said he had spoken to the case officer who had told him the hold-up had been the wording of the S106 agreement. He said he felt although the decision had been made he felt MCC should make their views on the handling of the application known to CBC, in particular with regard to the PRoW, and it was agreed that Cllr Johnstone and the Assistant Clerk would work together to do this.

The Chairman said there was a dispute between the St Aubyn’s Centre and residents over the fencing between properties. He said he had asked Alistair Day to put the matter in the hands of Planning Enforcement, and he would be keeping an eye on progress.

078-17/18     Monitoring

Cllr Hewitt brought Mersea Home’s Design Brief to the meeting.

The Committee felt that there should be referral back to the Design Panel’s workshop as the hub was integral to the whole development and would be a key feature. The Committee felt the Design Brief did not meet this requirement.

Cllr Hewitt said he would draft a response and pass to the Assistant Clerk for submission to CBC.

Cllr Hewitt brought plans for the Northern Gateway to the meeting and said he would continue to monitor and advise the Committee of progress.

079-17/18     To agree any action to be taken regarding issues arising from the junction of the Via Urbis Romanae with the A134.

It was agreed that Cllr Stewart would draft a letter to ECC to reiterate MCC’s views and to ask for appropriate action to be taken.

172098 – Colchester District General, Turner Road, Colchester CO4 5JL – New decontamination unit for the cleaning and sterilisation of Endoscopes – Comment

“MCC note that this building is almost complete. We feel it would have been proper to have been able to look at the application before work began. This is the third application at the hospital where this has been the case and MCC are very disappointed to note this.”
