Minutes of the Myland Community Council Planning & Development Policy Committee Meeting held on Wednesday 6th August 2014, 7.15 pm @ Myland Community Council Office, 101 Nayland Road, Colchester, CO4 5EN

Mrs White said she wished to comment with regard to the crossover of MCC and CBC planning. She said although she doesn’t always agree with the decisions and the comments made, there was no need for aggression against the CBC planning department.

She went on to ask why planning application 121272 – Chesterwell was under the planning appeals/decisions on the agenda. Cllr Hewitt explained that the reason it was there was because it was the final approval document signed by the developer and CBC, and it was a notification of this. Mrs White asked if MCC would now be involved in the Section 106 agreements discussions that would be taking place. The Chairman explained that the Section 106 agreements had already been signed off and that when the reserved matters applications come in is when MCC will be able to influence some of the outcomes as this will be done by parcels of land. Mrs White asked why it was done this way and the Chairman explained that that was the way most large developments worked. Cllr Hewitt said Countryside Properties and Mersea Homes had not yet decided whether they would be involving other developers at that time but Mersea Homes would be doing Phase 1. Cllr Hewitt sad that some of the conditions were already being met.

Mrs White requested a copy of the Decision Notice and the conditions. The assistant Clerk said she would make her a copy and send it to her that week.

The Chairman read aloud the following letters;

A copy of a Letter sent to Alistair Day at CBC regarding Planning application 121272 – Chesterwell Development from Mr P.A. Borges which refers to some of the conditions of approval.

A letter received from CBC regarding CBC’s comments to ECC on planning application 145086 (CC/COL/34/14) – Land North of Apprentice Drive, New Braiswick Park – New primary School.

And a letter received from CBC regarding planning application 121699 – Blue Gates, 2 Nayland Road, Colchester – conversion of existing house and construction of 7no. dwellings regarding the withdrawal of this application.

054-14/15     Matter arising from Minutes

Cllr Hewitt referred to the Chairman’s announcements from the previous minutes where he had volunteered to put together MCC’s comments regarding CBC’s Local Plan Sustainability Appraisal Scoping Report. He said he had circulated the document the previous week and wished to know if the committee were happy for him to submit this. The Committee agreed and the Chairman thanked Cllr Hewitt for volunteering to do this. Cllr Hewitt said he would email the final draft of the comments to the Assistant Clerk so she could forward it to the relevant people the next day.

055-14/15     Monitoring

There was no report.

Cllr Dickinson asked if anyone knew how many houses were occupied at Northfields as it was nearing completion. She suggested that committee members take a walk round there one evening. She asked if MCC were doing any monitoring of discharged conditions. The Chairman said CBC had to this. Cllr Dickinson said that Alistair Day needed to be copying MCC in on this and giving them a chance to comment. Cllr Hewitt said the Clerk was already talking to Vincent Pearce about MCC not being notified about discharged conditions.
