38-19/20 Apologies
There were no apologies to receive.
39-19/20 Declarations of Interest – Councillors to declare individually any interests they may have in the items on the agenda.
Cllr Clouston declared a pecuniary interest in Item 44-19/20, application 192202, due to the application site being close to her residence.

Cllr Dickson asked about the applications 183077 and 191581, which had been due to be considered by Colchester Borough Council’s Planning Committee on 26th September 2019. He said these applications related to access to the Chesterwell development through Bartholomew Court off Mile End Road.
The Chairman confirmed that application 183077 for temporary access had been granted, and application 191581 for permanent access had been refused.
41-19/20 Chairman’s Announcements and Correspondence
The Chairman circulated a letter received from a resident regarding the applications 183077 and 191581.
The Chairman brought to the Committee’s attention the amended Terms of Reference in which authority to spend within the allocated budget had now been delegated to the Committee by the Council.

43-19/20 To agree a response to Colchester Borough Council’s consultation on the proposed Colchester Local List selection criteria
Cllr Hewitt said he would look at the consultation documents and inform the Committee of his thoughts.
44-18/19 Planning, Licensing & Highways Applications/Appeals – To make recommendations, including requests for Section 106 money where applicable, on applications received
192202 – Chapmans Farm, Nayland Road, Colchester CO4 5HA – Outline application for demolition of all existing buildings and construction of a maximum of 27 houses on the existing site currently owned by Cants of Colchester
Cllr Clouston had declared a pecuniary interest in this application and left the room.
It was agreed to object to this application as follows:
- During consideration of the previous application for this site concerns about the density of the proposed development had been expressed. The Committee felt these concerns were still valid and suggested a reduction in the number of proposed properties to 20 would be of benefit.
- The Committee had concerns about the impact of this proposal on an area recently developed. It noted that the surrounding development had not been built when the previous application for Chapman’s Farm had been considered. It further noted that the Chesterwell streets had been designed for the number of houses on that development, and not to accommodate the traffic from an additional 27 dwellings. It expressed concern about access for emergency vehicles and rubbish/recycling collection vehicles.
- The Committee was concerned about the loss of trees on the site and noted the Borough Council’s previous policy of 2 for 1 tree replacement. It would ask CBC to ensure existing hedgerows remained protected.

It was agreed to object to this application as follows:
- The application is contrary to CBC’s own guidance on backland and infill development (Supplementary Planning Document, Backland and Infill Development, adopted 2009)
- MCC note the concerns raised in Natural England’s comments. The proposed development is adjacent to an area of ancient woodland and we would ask CBC to consider this in making their decision.
- MCC have concerns about provision of parking for the proposed property, especially as the existing dwelling on the application site appears to be a House of Multiple Occupation.

It was agreed to comment as follows:
MCC would have no objection to the two replacement building signs.
The Council would object to the installation of the flagpole as they can see no business requirement for this. It would also be out of keeping with the current street scene.
