Mrs White asked if the application for 248 Mill Road would be discussed. The Chairman said that application was not on this meeting’s agenda.
Mrs White said she would like to talk about the modifications to the conditions relating to the Severalls Phase 1 development. She said that the Clerk had been very helpful in explaining them to her. She said she had grave concerns about the raising of the land level by a metre, which had been done using the loose soil from the development. She said the raised land would be impenetrable to water, and the existing residents’ houses would be the soakaway. She said that she felt Severalls needed to be looked at in its entirety and not piecemeal. She asked MCC to consider asking to be consulted both on modifications already made to conditions, and any new modifications in the future. She said this would help residents to know where they stood. She said CBC needed to be specific about changes to the conditions in terms that residents could understand. She said CBC also needed to be clear about which masterplan they were using.
Cllr Hewitt said MCC had been through all the conditions with CBC. He said he would like to clarify that Mrs White had alerted the Enforcement Officer at CBC about the raised land levels, and that she had alerted MCC so that they can follow up. Mrs White said that that was the case. She said that CBC had said that the levels had been authorised. She said MCC should follow this up.
Mrs White thanked the Assistant Clerk for recording her comments at meetings and asked why Cllr Graham’s comments at the meeting held on 22th July 2015 during the discussion about Item 081-15/16 had not been recorded in a similar fashion. The Assistant Clerk said that she minuted the Have Your Say item, but that the discussions about proposals brought to the committee were not minuted. She said that usually only the outcome of the vote on each proposal would be minuted.
Mr McGarr joined the meeting.
088-15/16 Advance notification of Traffic Orders associated with the Chesterwell development
This item was taken after 085-15/16.
Cllr Turrell outlined the possible Traffic Orders associated with the Chesterwell development. She said that these were not yet finalised and that there might be amendments but that she would like MCC to have advance notice.
Cllr Turrell mentioned the possibility of a cycle path for Mile End Road.
The Chairman thanked Cllr Turrell for taking the time to come to the meeting to talk about the Traffic Orders.
Cllr Turrell left the meeting at 7.30pm.
089-15/16 Chairman’s Announcements and Correspondence
The Chairman said he had received notification of an application to discharge condition 19 of planning permission CC/COL/52/15, the new Severalls School. He said the condition required the submission of the landscape masterplan drawing with the staff car parking area turning head removed. He said this application included the drawing showing this amendment. He said he would therefore suggest that the committee should support the application.

With the amendment of ‘Miss Rogers’ to ‘Mrs Rogers’ under items 075-15/16 and 082-15/16, the minutes of the meeting held on 22nd July 2015 were approved as a true record and signed by the Chairman.

094-15/16 To consider and possibly resolve that in future Planning/Appeal Decisions will no longer be read out at the meeting, but instead will be reviewed by the Councillor who initially dealt with the application who will report any non-standard conditions to P&DP members. 095-15/16 Planning, Licensing & Highways Applications/Appeals – To make recommendations, including requests for Section 106 money where applicable, on applications received
151494 – Ivy Cottage, Leechs Lane, Colchester CO4 5EP – proposal to demolish existing structure containing two dwellings and to create three new 3 bedroom detached dwellings with gardens and parking along with turning area – Object
This application was discussed after 088-15/16 and before 086-15/16.
Mr Rosson said he had concerns regarding his property which incorporated the old bakehouse. He said the wall which would be closest to the development was already bowing and that the foundations would not be able withstand building work nearby. He said he had concerns about the proximity of the car parking spaces.
Mr Dickinson said there were four discrepancies in the application. He said that the plot size was incorrect, that the house had been used as a single dwelling for at least 15 years, that the plot was not directly connected to the highway and that a document lodged with MCC and CBC regarding bringing the junction up to standard had not been mentioned. He said there was an agreement between ECC and the residents of Leech’s Lane. He said applications for two extensions in the Lane had already been refused by CBC.
Mr McGarr said he was the agent for the applicant. He said he appreciated all comments and would make adjustments accordingly where genuine planning issues were concerned. He said that when looking at a project he would take on board all planning aspects and consider them carefully. He said he worked within ECC/CBC/NPPF guidelines, and that he would take all points made on board.
The Chairman thanked Mr McGarr for coming to the meeting and asked if anyone had any questions for him.
Cllr Sutcliffe asked if two bungalows rather than three houses had been considered.
Mr McGarr said they were looking at three houses.
Cllr Hewitt said he was concerned about the building of three houses in the context of the current street scene in Leech’s Lane which was predominantly bungalows.
Mr Revell said he was particularly concerned about the changes to the street pattern.
MCC would object on the grounds of over-development of the site, out of character with the street scene, overlooking and privacy issues for 44 and 46 Howards Croft, and the road not being fit for further traffic or construction traffic.
