Minutes of the Myland Community Council Planning & Development Policy Committee Meeting held on Wednesday 5th October 2016, 7.15 pm @ 101 Nayland Road, Mile End Road, Colchester, CO4 5EN

106-16/17     Chairman’s Announcements and Correspondence

The Chair said he had attended the Planning Liaison Group meeting on 27th September 2016. He said he had discussed pre-planning advice with Simon Cairns. He said he had seen two applications recently which had had pre-planning advice which had not been officially signed off. He said in these instances it could appear that CBC was almost nodding appreciation. He said he had asked Simon Cairns why this happened. He said that Simon Cairns had said that CBC preferred to give ad-hoc advice which was not binding on CBC, whose planning officers could change their minds when viewing the full application. He said Simon Cairns had said that CBC Planning were now also expected to be customer-focussed.

The Chair said he had attended the first meeting with the Severalls consortium. He said this had been a useful meeting. He said house building would not start before December at the earliest. He said he and Cllr Hewitt had raised the issue of the turning circle at the new school. He said they had been told that this was temporary but that the circle was on what would become the car park for the proposed community centre, and that no definition of “temporary” had been given. He said parking for school drop-off was against ECC policy. He said as the majority of children attending were coming from outside the parish, he wondered what was the benefit to Myland. He said he had raised this at the Planning Liaison Group meeting and had been told it was the developers’ land and nothing to do with CBC. The Chair said the land would be handed over eventually and at that point it would be CBC’s problem.

The Chair reminded the meeting that the Clerk had asked for Committee to think about money they might need for the 2017-18 financial year for budget purposes.

The Chair said that two appeals had been lodged. He said one was for application 160048, Land at the corner of Bergholt Road and Tufnell Way, which had been refused by CBC on 11th March 2016. He said the other appeal was for application 151885, land at Axial Way, which had been refused by CBC on 11th July 2016.

111-16/17     Planning, Licensing & Highways Applications/Appeals – To make recommendations, including requests for Section 106 money where applicable, on applications received

                      162374 – Nayland Lodge, 44-46 Nayland Road, Colchester CO4 5EN – Provision of an additional 5 bedroom care home, with related parking facilities and associated alterations to the existing access drive.

The applicant, Mrs Sarah Reed, addressed the meeting. She said she was being asked to take on more elderly clients with ongoing needs. She said the previous application for two bungalows which had been turned down had not been her vision for Nayland Lodge. She said she had five service users currently in her care and it was these for whom the new bungalow was needed. She said these people were already familiar with Nayland Lodge having previously visited the building. She said she wanted to provide them with a home for life.

She said in terms of impact the application had come down from two bungalows to one. She said she was very conscious of the neighbours’ concerns. She said she wanted to keep to minimum disruption. She said she would like to provide a nature garden and to enable residents to grow their own produce. She said car parking would be kept to a minimum and would be away from Nayland Road. She said the new development would be screened off from neighbours. She said she would employ local people, and employees and residents both used local shops. She said she would like to encourage links with the community. She said she was very open to suggestions to facilitate this.

The Chairman thanked Mrs Reed for attending the meeting and for her helpful comments.

It was resolved to object to the application.

MCC believe this application would result in further encroachment on the curtilage of this historic listed building.

It was resolved to object to this application.

MCC would object to this application on the same grounds as the previous application for this site. They also believe this is in conflict with CBC’s own designation of this area as a Strategic Employment Zone.

MCC would support this application as it stands but would comment that there should            be no additional access to the site from the Northfields estate.

MCC support this application but would have concerns about parking provision for the new building. We also note the concerns already expressed about the surface water drainage on the site.

MCC believe this should be the subject of a full application. In our opinion the information provided is inadequate for making a full decision. There are no scales, dimensions or areas shown and the plans do not show the boundaries with nos. 78 and 80. The development will add significantly to the area of the existing building. MCC believe CBC should investigate further.
