Minutes of the Myland Community Council Planning & Highways Committee Meeting held online on Wednesday 5th August 2020, 7.30pm.

There were three members of the public present.
18-20/21 To receive apologies for absence
Apologies were received from Cllr Catherine Clouston (holiday) and acceptance of these was confirmed.
19-20/21 Declarations of Interest
All committee members made a non-pecuniary disclosure of their awareness that in application 201394 the applicant and one of the public commentators had previously been members of this Planning Committee and were ex-Councillors.

Two residents said they wished to speak on application 201394.
The Chairman said their comments could be made when the application was discussed.
21-20/21 Chairman’s Announcements and Correspondence
The Chairman said an application for the Northern Gateway Western Section had been lodged with the Borough Council on 3 August 2020 and would be notified to this committee in due course.
He said from the next meeting applications would be allocated to individual councillors, reverting to practice followed prior to March 2020.
He asked the Clerk to chase for a response sent to Essex Highways regarding the re-surfacing of Braiswick Lane, following the last meeting.

23-20/21 Planning, Licensing & Highways Applications/Appeals
201358 – 42 Nayland Road, Colchester CO4 5EN – Erection of single storey orangery and entrance porch
Cllr Johnstone noted the lack of information on this application.
It was agreed to support this application.
192890 – North Colchester Urban Ext, Mile End Road, Colchester – Application for approval of reserved matters following outline approval 121272 – Construction of 17no. dwellings at Parcel NC1
It was agreed to comment as follows:
MCC welcome the reduction in dwellings from 24 to 17.
We refer to our previous comments for this application which ask for consideration to be given to allow the application site to contribute to a bigger plaza area for communal outdoor use. The proposed dwellings will already have been planned for elsewhere on the development and MCC sees no need to build them on this site.
201480 – 19 Defoe Crescent, Colchester CO4 5LQ – Demolition of an existing rear extension and erection of a single storey rear extension with a flat roof
It was agreed to support this application.
201394 – 4 Leechs Lane, Colchester CO4 5EP – Erection of a four-car garage with an annex on the first floor
The Chairman invited comments from members of the public on this application.
A resident said the proposed dwelling would be out of alignment with the building line and would create issues with overlooking of their property. She said the building was very close to the fence dividing the two properties and that previous applications for two-storey dwellings had been refused.
A resident said that the application was inappropriate for the location. She questioned the need or four car ports and said this would lead to too much traffic in the Lane. She said she would suggest reducing the car spaces to two and moving the building back further on the plot. She said she objected to the proposed flat above the carports and believed this to be over-development of the site.
A resident said she lived on Howards Croft and would reiterate what had previously been said. She said the proposed dwelling would block light to the back of her house and garden and would overwhelm the neighbouring properties.
Cllr Johnstone left the meeting.
It was agreed to comment as follows:
“MCC believe the proposed dwelling would result in loos of amenity to adjacent properties in Howards Croft and potentially to the property opposite the application site in Leechs Lane.”

It was agreed to support this application.

It was agreed to support this application.

It was agreed to support this application.

It was agreed to support this application.

It was agreed to support this application.
Cllr Johnstone said he would like to raise a point of order. He said he had objected to application 201394.
The Clerk said the connection had broken up at that point in the meeting and she had no record that he had said that.
Cllr Johnstone said he would like it recorded that he had objected to the application.

201086 – 16 Turner Road, Colchester CO4 5LB – Application to vary conditions 2, 8 and 9 of planning permission 190624 to allow for new drawing numbers to reflect minor alterations for private meeting space. – Permission granted, 16 conditions, 16th July 2020
25-20/21 To agree the time, date and place of next meeting
It was agreed that the next meeting would be held online on Wednesday 2nd September 2020 at 7.30pm.
The meeting closed at 8.33pm.
