152-16/17 Declarations of Interest – Councillors to declare individually any interests they may have in the items on the agenda. If a Councillor has a disclosable pecuniary interest in a matter being considered at a meeting, he/she must not participate in any discussion or vote on the matter at the meeting. The Councillor must withdraw from the room where the meeting is being held unless he/she has received a dispensation from the Clerk.
Cllrs Dickinson and Hewitt declared a pecuniary interest in application 163202 due to the application site being close to their residences. All Cllrs had requested dispensation in writing to the Clerk, on the grounds that so many members of the decision-making body (P & DP Committee) have a Disclosable Pecuniary Interest in the matter that it would “impede the transaction of the business”.
With regard to application 163202, as per provisions in the Localism Act and having had regard to all relevant circumstances, the Clerk and Chairman consider that dispensation be granted to all Cllrs on the grounds that so many members of the Committee have disclosable pecuniary interests in the matter that it would “impede the transaction of the business” not to do so.

154-16/17 Chairman’s Announcements and Correspondence
The Chairman circulated a copy of the article from the Colchester Daily Gazette regarding the conversion of Equity House in Bergholt Road to the committee, which mentioned MCC’s objections to the application.
The Chairman said MCC had received notification of the Inquiry into application 151885 (Axial Way, Colchester – Detailed planning application for residential development to provide 87(no.) residential dwellings (use Class 3), associated car parking, cycle parking, public open space and pedestrian/cycle infrastructure, formation of pedestrian and cycle only links to adjacent Public Footpath/Bridleway and other associated works and improvements at land north of Axial Way, Colchester). He said the Inquiry would take place at the Town Hall, High Street, Colchester CO1 1DZ on 9th May 2017.
The Chairman said MCC had received notification from ECC of the Essex County Council (Various Roads (Former Severalls Hospital Site), Myland) (20mph Zone) Order 201*.

159-16/17 To agree the official response to the WSP/Parsons Brinckerhoff submission(s) on the Colchester Northern Gateway Car Park Access Road and United Way Crossing and Public Transport Proposals as follows – Cllr Stewart
MCC is grateful to consultants WSP|Parsons Brinckerhoff for their further submission to address our concerns about the car park access proposals for the Northern Gateway cinema/restaurant complex. However, whilst still supporting the development, MCC retain their concerns over this scheme and its potential for gridlock at this busy junction. MCC would, however, support the provision of a Pedestrian Crossing in United Way. In respect of public transport access, MCC view the provision of a public transport alternative to be vital to this project. The direct access bus route proposed by WSP has merit and would appear to be the logical solution. The alternative bus route suggested by ECC/CBC covering a much wider area is, in our view, unlikely to encourage non-car use due to its extended route. The proposal by Carter Jonas that a Public Transport Enhancement Scheme be included within the proposed s.106 agreement makes sense and would be supported by MCC. MCC would, of course, seek to be included in future discussions on proposals towards this latter provision.

160-16/17 Planning, Licensing & Highways Applications/Appeals – To make recommendations, including requests for Section 106 money where applicable, on applications received
163202 – North Colchester Urban Extension, Mile End Road, Colchester – Reserved matters application following outline consent 121272 for green infrastructure and open space at Chesterwell Park. Also to part discharge conditions 1, 7, 15, 39 and 45. The outline approval was an EIA application.
It was agreed to support this application with the following comment:
“There is an effective mix of wildlife habitat protection and open leisure space. Good use is made of the topography and necessary water attenuation to provide a range of attractive features. It is worth noting that Mersea Homes have agreed to link footpaths elsewhere in Myland into this Park area. Part discharge of conditions 1, 7, 15, 39, and 45 is noted.”

It was agreed to support this application with the following comment:
“MCC would support this application as it stands although we would ask that the figures in Clause 10 of the submission are checked. For information, MCC would also support the provision of the residents-only parking zone, should the application to CBC/NEPP be successful.”
