Minutes of the Myland Community Council Planning & Development Policy Committee Meeting held on Wednesday 1st May 2016, 7.15 pm @ 101 Nayland Road, Mile End Road, Colchester, CO4 5EN

49-16/17       To review the P&DP Committee Terms of Reference and agree any amendments

The P&DP Committee Terms of Reference were reviewed and it was agreed to make two amendments – to add Licensing into (a) and to reword Monitoring (f) – delegated to Cllr Dickinson to be agreed by Committee members via email.

50-16/17       If any amendments to the Terms of Reference of the Planning & Development Policy Committee are agreed to consider and possibly resolve to make those recommendations to the full Council

                      It was resolved to recommend the amendments to the Terms of Reference of the Planning & Development Policy Committee to the full Council.

51-16/17       To consider and possibly resolve to hold meetings of the Planning & Development Policy Committee once a month instead of twice a month (suggested dates 6th July 2016, 10th August 2016, 7th September 2016, 5th October 2016, 9th November 2016 and 7th December 2016)

It was resolved to hold meetings of the Planning & Development Policy Committee once a month instead of twice a month – changing the suggested July date.

Dates for remainder of 2016:

13th July, 10th August, 7th September, 5th October, 9th November and 7th December.

Following receipt of further information MCC Planning Committee now believes there has been failure to comply with both Condition 7 and Condition 8 of planning permission 97/0939.

LICENSING APPLICATIONS

David Lloyd Leisure Ltd, United Way, Mile End, Colchester – Leisure centre with facilities for food and beverage provision with occasional entertainment facilities

Provision of films, live and recorded music, performances of dance indoors and outdoors and sale of alcohol on and off the premises Mondays to Sundays  from 10.00 to 00.00; and Late night refreshment on and off the premises Mondays to Sundays  from 23.00 to 00.00; the premises to close 30 minutes after the end of regulated entertainment.  On up to 18 occasions per year the provision of regulated entertainment, the sale of alcohol and the provision of late night refreshment Sundays to Thursdays until 01.00 and Fridays and Saturdays until 02.00; the premises to close 30 minutes after the end of regulated entertainment.  Object.

Currently Weston Homes Stadium, located across the road from these premises, already have a drinks licence and holds live entertainment. The new North Section of the Northern Gateway opposite will also have licence(s) and so will the restaurants and a cinema.

 

MCC supported the building of the David Lloyd Centre but it was never envisaged by us that they would seek to turn into an ‘out of town’ club. It appears to this council that there is no reason to grant this application. We are especially concerned regarding the ‘off site’ liquor request. A large housing estate is being built adjacent to these premises and the Rosewood Estate is only a couple of hundred yards away as will be the new Community Centre. Both of these areas are likely to suffer public nuisance and the possibility of crime and disorder.

The main use of Northern Gateway is sports orientated and applications such as this do not support that ethos. This council firmly believes that CBC Licensing Panel should refuse this application.

General Stores, 28A Turner Road, Colchester, CO4 5LB

Sale of alcohol for consumption off the premises Mondays to Saturdays from 08.00 to 23.00 and Sundays from 10.00 to 22.30.  Object.

These premises are located in a residential area. It is less than 100 yards from an ‘additional provision’ school and less than a mile from the Colchester General Hospital and also The Lakes psychiatric wing. This council cannot envisage why there is a need to provide alcohol either at 05:00 or till 23:00 7 days a week. It is our view that these opening hours may well facilitate drunkenness and public safety issues as well as become a nuisance to residents. Colchester General Hospital already suffers problems with intoxicated persons and this provision may well exacerbate this. The close proximity to a school also raises concerns as to pupil’s safety and harm. This council therefore objects to any change to the licence for these premises.
