Minutes of the Myland Community Council Planning & Development Policy Committee Meeting held on Wednesday 6th April 2016, 7.15 pm @ 101 Nayland Road, Mile End Road, Colchester, CO4 5EN

1-16/17         Apologies

2-16/17         Declarations of Interest

Cllr Dickinson declared a pecuniary interest in application 160603 due to the application site being close to her residence.

Cllr Dickinson said that there had been major progress with regard to Leech’s Lane and that the new application was very good in terms of the site and the proposed housing. She said there were items which were not addressed in the application but arose because of the layout of Leech’s Lane. She said that with regard to site B, getting vehicles in and out of the three parking spaces would prove very difficult. She said the application as it stood would result in the loss of the two visitors’ parking spaces at the end of the Lane which were very important to the residents. She said the berberis hedge would be lost which the residents wanted to retain. She said Leech’s Lane Residents’ Group had written to CBC to request that the parking spaces and the front garden were switched. She said this would allow the fence and the visitors’ parking spaces to be retained and that manoeuvring in and out of the proposed spaces would be much easier. She said she would support the application if flipping the spaces and the garden was recommended.

Mr Rosson said that his house adjoined the application site. He was concerned as to how the developer would protect the wall of his house as he was concerned the structure of his house could be compromised. He said his house was delicate. He said the proposal showed two parking spaces down the side of his house. He said he was concerned that if driven carelessly cars would clip his wall. He said he needed access to the side of his house to maintain gutters. He said because of its age, his house ‘sits down’ in the soil. He said construction of the new parking spaces would be above his house’s damp proof course. He said he would hope that there would be a simple solution but that he wanted to be sure the structure of his house was not compromised by the development.

Cllr Dickinson said that letters written by the Leech’s Lane Resident’s Group were available to members of the committee.

Mr Rosson it would be important to protect the lane during construction. He said the turning head would need protection. He said although concerns remained this application was a big step forward.

There was no monitoring report.

Cllr Hewitt said that Cllr Gray had mentioned in a previous meeting the possibility of beginning to monitor the Chesterwell development. He said this might not be necessary in view of the matrix of conditions provided to MCC by CBC and because of the regular Planning Liaison meetings.

Cllr Gray said she would be looking to monitor the Bluegates development.

160623 – Colchester Northern Gateway Land at Cuckoo Farm West, off United Way and Via Urbis Romanae, Colchester, Essex – Reserved matters application following outline planning permission O/COL/01/1622 for the erection of Use Class A3 restaurant units (10,400sq m), erection of Use Class C1 hotel (80 beds), provision of a landscaped piazza and associated landscaped areas, erection of an ancillary multi-storey car park and the provision of separate drop-off/parking areas (EIA application) – Comment

MCC has concerns regarding the decision to proceed with this planning application without the inclusion of the cinema complex. We do not feel that the site without the cinema will attract the required number of visitors to make it viable. We take the view that this application should have been stayed until the cinema could be included. MCC have concerns over the proposed entrance slip road to the carpark.On busy days this has the potential to cause gridlock on what is now a major gateway to Colchester. MCC are also puzzled as to why the Scoping Report for this application is separately listed as 160499. There are references in that report under transport that do not appear to make sense. It refers to this project alleviating traffic flows and environmental concerns regarding Mile End Road, Mill Road and Turner Road. We are at a loss to see how this can be stated or verified. Whilst MCC has overall support for the project because of these concerns we must confine our response to ‘Comment’ only.

160465 – 210 Bergholt Road, Colchester, CO4 5AS – Proposed new 1 bedroom bungalow to rear of property – Object

MCC would object to this application as we did to the previous application for this site (152290). Our concerns are the shared sewerage once another house is added to the current system, which is old and probably not up to current building standards, access to the proposed dwelling, and insufficient provision for a driveway and a turning area. We are also concerned about impairment of amenity for existing residents. As with the previous application we feel that there is no benefit to housing numbers in the building of a one bedroom dwelling and the application would lead to over-development of the site.

MCC have no comment on this application as we could find no reference to Condition 19 on the original planning application O/COL/03/1019

160603 – Ivy Cottage, 4 Leech’s Lane, Colchester CO4 5EPDemolition of existing large detached residential unit split into two flats, to create site for two new one and a half storey dwellings. Resubmission of 152594 Council recommending submission for two units – Support

MCC are pleased that progress has been made since the previous application for this site (152594). MCC still have concerns about the parking provision and would suggest that the current configuration on Site A is impractical. We would suggest that if the parking spaces and the front garden are switched, manoeuvring in and out of the spaces would be greatly eased and the visitors’ spaces at the end of the Lane would be retained. The spaces on Site B are in very close proximity to the neighbouring property and we have concerns about the potential for damage to this property.

MCC feel that it is very important that the Lane is protected from the impact of construction traffic.

MCC is pleased to see that the number of proposed dwellings has been reduced to two and the height of the properties has been lowered.
